1) Introduction

We take the protection of your data seriously. This Privacy Policy explains how Provoqué GmbH (“we”, “us”, “our”) collects, uses, discloses, and protects information in connection with our websites, online shop, and related services (the “Services”).

By using the Services, you acknowledge this Policy. If you do not agree, please discontinue use of the Services.

Applicable law: Swiss Federal Act on Data Protection (revDSG). Where you are in the EEA/UK and we target you or monitor your behaviour, the GDPR/UK GDPR may also apply.

2) What data we collect

a) Non-personal data (non-identifiable)

Technical and aggregated usage data generated during use of the Services (e.g., device/browser type, language settings, referrer URL, pages viewed, time spent, approximate location from IP, performance metrics).

b) Personal data (identifiable)

Information that can identify you directly or indirectly, such as:

  • Contact & identity data (name, email, shipping/billing address, phone)

  • Account/order data (orders, returns, support requests)

  • Payment and transaction data (tokenized payment details via our payment providers; we do not store full card numbers)

  • Technical identifiers (IP address, cookie IDs, logs)

  • Marketing preferences (newsletter opt-in/opt-out)

If we combine non-personal with personal data, we treat the combination as personal data.

3) How we collect data

  • Directly from you (e.g., checkout, forms, support messages, newsletter sign-up)

  • Automatically when you use the Services (cookies, pixels, SDKs, log files)

  • From third parties (e.g., payment processors, logistics providers, analytics/advertising partners), and when you sign in via third-party accounts where available

4) Why we process your data (purposes & legal bases)

  • Provide & operate the Services (orders, payments, fulfilment, returns, customer support) – contract performance

  • Improve, personalise & secure the Services; detect/prevent fraud – legitimate interests / legal obligations

We use cookies, pixels, tags, and scripts to:

  • enable core site functions (e.g., cart, checkout, authentication)

  • measure performance and usage (e.g., analytics)

  • deliver/measure marketing (e.g., ad pixels where used)

6) Online advertising (if used)

We may work with advertising partners (e.g., Meta/Google ad platforms) to deliver interest-based ads based on your interactions with the Services and other sites/apps. This may involve cookies or mobile identifiers. Where required, we request your consent. You can withdraw consent in the cookie banner/settings and use platform tools (e.g., Ad Preferences on Meta/Google).

We do not sell personal data in the common sense of the term. (See CCPA note below.)

7) Sharing your data

We share data only as necessary for the purposes above, including with:

  • Hosting & infrastructure providers

  • Payment processors (PCI-DSS compliant)

  • Logistics & fulfilment partners (carriers, warehouses)

  • Customer support & communication tools

  • Analytics/marketing partners (where consented/legitimate)

  • Professional advisors (legal, tax, audit)

  • Authorities where legally required or to protect rights/safety

  • Corporate transactions (merger, acquisition, asset sale)

We may share non-personal/aggregated data at our discretion.

8) International data transfers

We and our trusted providers may process data globally (e.g., Switzerland, EEA, UK, USA, Israel, etc.). Where required, we rely on appropriate safeguards (e.g., EU Standard Contractual Clauses, adequacy decisions) to ensure an adequate level of protection.

9) Data retention

We keep personal data only as long as necessary to provide the Services, comply with legal/contractual obligations, resolve disputes, and enforce agreements. We may correct or delete inaccurate or incomplete data at our discretion.

10) Security

Our hosting provider supplies secure infrastructure with firewalling and HTTPS access. Payment processing follows PCI-DSS requirements. Nevertheless, no method of transmission or storage is 100% secure. Please use strong, unique passwords and avoid sending sensitive data via email/IM.

11) Children

Our Services are not intended for minors under the age of majority. We do not knowingly collect data from children. If we learn that a minor is using the Services, we may suspend access and delete data as appropriate. If you believe a minor provided data to us, contact us (see Section 15).

12) Your rights

Swiss/EEA/UK residents (as applicable)

You may have the right to:

  • access and obtain a copy of your personal data

  • rectify inaccurate data

  • erase data (right to be forgotten)

  • restrict or object to processing

  • data portability

  • withdraw consent at any time (does not affect prior processing)

California residents (CCPA/CPRA)

You may have rights to request access or deletion of certain personal information. We do not sell personal information. To submit a request, contact info@provoquewatches.com and include “California Privacy Request”.
If we host any user-generated content areas, California users under 18 may request removal of posted content by contacting us with “California Removal Request” and sufficient detail to locate the content (removal may not be complete in all cases).

13) User-generated content / social features (if available)

If the Services allow posting content (e.g., comments, reviews), anything you share may be read, collected, and used by others. Public posts are at your own risk. Copies may remain available in caches/archives or if others saved them.

14) Third-party links

Our Services may link to third-party sites/services. We are not responsible for their privacy practices. Review their policies before providing data.

15) Changes to this Policy

We may update this Policy from time to time. The current version is posted on our website (see “Last updated” above). Material changes will be highlighted on the site. Continued use of the Services after changes constitutes acceptance.
