1. Scope and Applicability

These Terms and Conditions (“Terms”) apply to all purchases and interactions between Provoqué GmbH, Rebenstrasse 11, 4421 St. Pantaleon, Switzerland (hereinafter “Provoqué”, “we”, “us”, or “our”) and the customer (“you”, “your”) via our online shop or any other sales channel operated by Provoqué.

By placing an order through our website or associated channels, you confirm that you have read, understood, and agreed to these Terms.

3. Conclusion of Contract

A purchase contract is concluded once your order has been confirmed by email from Provoqué.
All product information, prices, and availability are subject to change and do not constitute a binding offer until confirmed.

We reserve the right to refuse or cancel any order, for example, if a product is out of stock, mispriced, or suspected to be fraudulent.

4. Prices and Payment

All prices are listed in Swiss Francs (CHF) and include VAT (where applicable).
Prices do not include shipping costs, which are displayed during checkout.
Provoqué reserves the right to change prices at any time; however, the price applicable at the time of your order shall apply.

Accepted payment methods include (depending on the platform):
Credit card, Twint, PayPal, Apple Pay, or other options listed at checkout.

Payment is due immediately upon order confirmation.

5. Shipping and Delivery

We ship within Switzerland and internationally.
Delivery times depend on destination and shipping method, and will be shown during checkout.
Delays caused by customs, import procedures, or external logistics are outside our control.

Import duties and taxes outside Switzerland are the customer’s responsibility.

The risk of accidental loss or damage passes to the customer once the goods are handed over to the carrier.

6. Right of Withdrawal (Returns)

You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period begins on the day you receive the goods.

Returned goods must be unused, in original packaging, and accompanied by proof of purchase.
Return shipping costs are borne by the customer.
Once the goods are received and inspected, refunds will be processed using the original payment method.

7. Warranty

All Provoqué watches are covered by a two-year warranty from the date of purchase.

However, the execution of warranty services (repair or replacement) is performed by our manufacturing partner in China, who is responsible for technical evaluation and execution of warranty claims.
Provoqué GmbH acts as an intermediary and communication partner but does not itself perform the technical warranty work.

The warranty covers manufacturing defects and material faults only.
It does not cover:

Normal wear and tear
Damage caused by misuse, impact, or water exposure beyond the stated resistance
Unauthorized repairs or modifications

If you wish to make a warranty claim, contact us at info@provoquewatches.com with photos, proof of purchase, and a description of the issue.

8. Liability

Provoqué GmbH is only liable for damages resulting from gross negligence or intent.
Liability for indirect or consequential damages (e.g. loss of profit, data loss, or emotional distress) is excluded to the fullest extent permitted by law.

9. Product Information and Availability

We strive to display our products as accurately as possible, but colors and materials may appear differently depending on your device.
All products are limited editions; availability cannot be guaranteed.

10. Intellectual Property

All texts, images, logos, designs, and other materials on our website are protected by copyright and other intellectual property laws.
Reproduction or commercial use without prior written consent from Provoqué GmbH is prohibited.

11. Privacy and Data Protection

We collect and process your personal data according to our Privacy Policy, which complies with the Swiss Federal Data Protection Act (revDSG) and, where applicable, the EU GDPR.
By using our website, you consent to the collection and processing of your data as outlined in that policy.

12. Force Majeure

We are not liable for delays or failures to perform due to events beyond our control, including natural disasters, war, strikes, pandemics, governmental restrictions, or disruptions in logistics networks.

13. Applicable Law and Jurisdiction

These Terms are governed by Swiss law, excluding its conflict-of-law rules.
The exclusive place of jurisdiction is Solothurn, Switzerland.
